Please read these Terms of Service ("Terms") carefully before using the Mamoru mobile application ("App") operated by Mamoru ("we," "us," or "our").
Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Description of Service
Mamoru is a daily safety check-in application that allows users to:
- Check in daily to confirm their well-being
- Designate emergency contacts (via email or paired Mamoru users)
- Have emergency contacts notified if check-ins are missed beyond a user-defined threshold
Account Registration
To use Mamoru, you must:
- Sign in using Apple Sign In
- Be at least 13 years of age
- Provide accurate information
- Maintain the security of your account
User Responsibilities
By using Mamoru, you agree to:
- Use the App only for its intended purpose
- Only add emergency contacts who have consented to receive alerts
- Not use the App for any illegal or unauthorized purpose
- Not attempt to interfere with or disrupt the App's functionality
- Keep your account credentials secure
Emergency Contact Consent
When you add an emergency contact to Mamoru, you represent that:
- You have obtained consent from that person to receive safety alerts about you
- You have provided them with accurate information about how Mamoru works
- The contact information you provide is accurate and belongs to the intended recipient
Limitation of Liability
Important: Mamoru is designed as a supplementary safety tool and should NOT be relied upon as your sole emergency notification system.
- We do not guarantee that alerts will always be delivered successfully
- Email delivery depends on third-party email providers
- Push notifications depend on device settings and network connectivity
- Mamoru is not a substitute for emergency services (911, 999, etc.)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAMORU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Service Availability
We strive to maintain App availability but do not guarantee uninterrupted service. We may:
- Modify or discontinue features with or without notice
- Perform maintenance that temporarily affects availability
- Suspend accounts that violate these Terms
Termination
You may stop using Mamoru at any time by deleting your account through the App settings. We may terminate or suspend your account if you violate these Terms.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms.
Apple App Store Terms
If you downloaded Mamoru from the Apple App Store, the following additional terms apply:
- These Terms are between you and Mamoru, not Apple. Mamoru, not Apple, is solely responsible for the App and its content.
- Apple has no obligation to provide any maintenance or support services for the App.
- Apple is not responsible for any claims relating to the App, including product liability claims, failure to meet legal requirements, or consumer protection claims.
- In the event of any third-party intellectual property claim, Mamoru, not Apple, is responsible for the investigation, defense, and settlement of such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.
